1.1. By downloading, installing, registering with, accessing, or using our mobile application (hereinafter referred to as the "App"), these Terms and Conditions (hereinafter referred to as "Terms") will automatically apply to you. Please read them carefully before using the App.
1.2. These Terms constitute a binding legal agreement between you (the "User" or "You") and Halil Eren ("Developer", "We", "Us", or "Our"). By using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the App.
2.1. "App" refers to our mobile application, including all software, code, design, text, graphics, and interfaces provided therein.
2.2. "Services" refers to the image editing, AI character generation, content creation, and sharing functionalities provided through the App.
2.3. "User Content" refers to any text, images, photos, scripts, prompts, or other materials uploaded, input, or generated by the User through the App.
2.4. "Tokens" refers to the in-app virtual currency or credits used to access certain premium features or generation capabilities.
2.5. "Output" refers to the images, text, or personas generated by the artificial intelligence models within the App based on the User's input.
3.1. You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the App.
3.2. If you are under 18, you may only use the App with the explicit consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
3.3. By using the App, you represent and warrant that you meet these eligibility requirements and that you are not barred from using the App under the laws of the applicable jurisdiction.
4.1. Subject to your strict compliance with these Terms, Halil Eren grants you a limited, non- exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use.
4.2. You agree strictly NOT to, and you will not permit others to:
4.2.1. Copy, modify, adapt, translate, or create derivative works of the App or any part thereof.
4.2.2. Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
4.2.3. Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from the App.
4.2.4. Use the App for any revenue-generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended, unless explicitly authorized by the Developer.
4.2.5. Use the App to build a competitive product or service.
4.2.6. Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine", or in any way reproduce or circumvent the navigational structure or presentation of the App.
5.1. Halil Eren reserves the right to charge fees for certain features or services. We will provide clear notice of any applicable fees before you incur them. All fees are exclusive of applicable taxes, unless otherwise stated.
5.2. Specific terms regarding Virtual Currency (Tokens):
5.2.1. The App utilizes "Tokens" for AI generation tasks. Tokens are a limited license to use a feature of the App.
5.2.2. You acknowledge that you do not own Tokens. They have no monetary value and cannot be exchanged for cash, real currency, or any other value outside of the App.
5.2.3. Tokens are non-transferable and may not be sold, traded, gifted, or exchanged between users.
5.2.4. We reserve the right to set expiration dates for Tokens, subject to applicable law.
5.2.5. All purchases of Tokens and Subscriptions are final and non-refundable, except as strictly required by applicable law or the mandatory policies of the Apple App Store.
5.3. If you purchase a recurring subscription, your payment method will be charged automatically at the start of each billing period. You may cancel your subscription at any time through your Apple ID account settings. Cancellation will be effective at the end of the current billing period.
6.1. You are solely responsible for all User Content you upload, post, generate, or share using the App. You represent and warrant that you own all rights to your User Content or have obtained all necessary permissions.
6.2. By submitting Input or generating Output, you grant Halil Eren a worldwide, non-exclusive, royalty-free, fully paid-up, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such User Content in connection with the App and Halil Eren's (and its successors' and affiliates') business.
6.3. This license includes the right to use User Content to train, improve, debug, and develop our artificial intelligence models and safety systems.
6.4. Subject to your compliance with these Terms, Halil Eren assigns to you all its right, title, and interest in and to the Output generated by the App based on your Input. This assignment is limited to the extent legally permissible and does not include any underlying software, algorithms, or pre- existing intellectual property of Halil Eren.
6.5. Copyright Misuse: You strictly agree not to use the App to upload, edit, or generate content that infringes upon the copyright, trademark, privacy, publicity, or other intellectual property rights of any third party. Halil Eren acts merely as a technological tool provider and does not review all User Content. You bear full legal liability for any infringement caused by your Inputs.
7.1. To ensure a safe environment, you agree strictly NOT to use the App to create, upload, or share content that falls into the following categories:
7.2. Sexual Content and CSAM (Zero Tolerance): It is strictly forbidden to generate or upload content that depicts child sexual abuse material (CSAM), nudity, sexual exploitation of minors, sexually explicit material, pornography, or obscenity. Halil Eren has no liability for such content generated by the user in violation of these Terms.
7.3. Deepfakes and Impersonation: It is strictly forbidden to impersonate any real person (celebrity, politician, or private individual) without their express written consent, or to use the App to deceive or mislead others into believing an AI-generated image is real.
7.4. Violence and Hate Speech: It is strictly forbidden to promote violence, incite hatred against individuals or groups based on race, religion, gender, sexual orientation, or other protected characteristics.
7.5. Illegal Acts: It is strictly forbidden to promote or depict illegal activities, self-harm, cruelty to animals, or any other unlawful act.
7.6. Consequences: Halil Eren reserves the right to review, remove, or disable access to User Content that violates these Terms. We may also suspend or ban your account immediately and without notice if you violate these provisions. We cooperate fully with law enforcement regarding illegal content.
8.1. It is your responsibility to keep your device and access to the App secure. We strongly advise against jailbreaking or rooting your device, as this exposes your device to security risks and may cause the App to malfunction.
8.2. We may from time to time provide enhancements or improvements to the features/functionality of the App, which may include patches, bug fixes, updates, upgrades, and other modifications ("Updates"). You agree that Halil Eren has no obligation to provide any Updates, or to continue to provide or enable any particular features. You agree to download and install all Updates.
8.3. By using the App, you agree to the collection and use of information as detailed in our Privacy Policy. You acknowledge that data transmission over the internet is never completely secure.
9.1. The App may contain links to third-party websites, services, or advertisements that are not owned or controlled by Halil Eren.
9.2. We assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Halil Eren shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.
10.1. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND.
10.2. HALIL EREN, ON HIS OWN BEHALF AND ON BEHALF OF HIS AFFILIATES, EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE APP, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
10.3. HALIL EREN PROVIDES NO WARRANTY THAT THE APP WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE, OR WORK WITH ANY OTHER SOFTWARE, OPERATE WITHOUT INTERRUPTION, OR BE ERROR- FREE.
10.4. Specific Disclaimer for Sexual/Illegal Use: The App is designed with safety filters, but AI models can be unpredictable. Halil Eren explicitly disclaims any responsibility for content generated by the User that bypasses these filters or violates the Prohibited Conduct policy. The User assumes full and sole liability for the creation, possession, and distribution of any sexual, illegal, or offending material.
11.1. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HALIL EREN OR HIS AFFILIATES BE LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, COST OF SUBSTITUTE GOODS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COMPUTER FAILURE OR MALFUNCTION, OR ANY OTHER CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES.
11.2. DIRECT DAMAGES SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE APP DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION.
11.3. No Liability for Misuse: Under no circumstances shall Halil Eren be liable for any claims, damages, or legal actions arising from the User's use of the App to generate infringing, illegal, sexual, or defamatory content. The User agrees that they are the sole creator of such content and Halil Eren is merely the provider of the tool.
12.1. You agree to indemnify, defend, and hold harmless Halil Eren and his officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising from or relating to:
12.1.1. Your use or misuse of the App;
12.1.2. Your breach of these Terms;
12.1.3. Your User Content (including any claim that your content violates the rights of a third party or applicable laws regarding obscenity);
12.1.4. Your violation of any law or the rights of a third party.
13.1. Halil Eren shall not be liable for any failure to perform his obligations hereunder where such failure results from any cause beyond Halil Eren's reasonable control.
13.2. Such causes include, without limitation, mechanical, electronic or communications failure or degradation, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
14.1. These Terms are governed by and construed in accordance with the internal laws of the Republic of Turkey without giving effect to any choice or conflict of law provision or rule.
14.2. Any legal suit, action, or proceeding arising out of or related to these Terms or the App shall be instituted exclusively in the Courts and Execution Offices of Istanbul (Çağlayan), Turkey. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
If you have downloaded the App from the Apple App Store, the following additional terms apply:
15.1. Acknowledgement: You and Halil Eren acknowledge that these Terms are concluded between you and Halil Eren only, and not with Apple Inc. ("Apple"). Halil Eren, not Apple, is solely responsible for the App and the content thereof.
15.2. Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
15.3. Maintenance and Support: Halil Eren is solely responsible for providing any maintenance and support services with respect to the App. You and Halil Eren acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
15.4. Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
15.5. Product Claims: You and Halil Eren acknowledge that Halil Eren, not Apple, is responsible for addressing any claims of you or any third party relating to the App or your possession and/or use of that App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
15.6. Intellectual Property Rights: You and Halil Eren acknowledge that, in the event of any third-party claim that the App or your possession and use of that App infringes that third party's intellectual property rights, Halil Eren, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
15.7. Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
15.8. Third Party Terms: You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
15.9. Third Party Beneficiary: You and Halil Eren acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
16.1. If any provision of these Terms is illegal or unenforceable under applicable law, the remainder of the provision will be amended to achieve as closely as possible the effect of the original term and all other provisions of these Terms will continue in full force and effect.
16.2. No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder.
17.1. Halil Eren reserves the right, at his sole discretion, to modify or replace these Terms at any time.
17.2. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
